Terms of Service, Privacy Policy & Communication Consent

By accessing or using services provided by Pulse Marketing Solutions LLC ("Pulse," "we," "us," or "our") — including our website, BuzFlo platform, consulting services, and any other offerings — you ("you," "Client") agree to be bound by these Terms of Service.

If you do not agree to these terms, do not use our services. These terms constitute a legally binding agreement between you and Pulse Marketing Solutions LLC.

Pulse offers digital marketing services, software development, BuzFlo platform licenses, AI agent setup, and related professional services. Specific scope, deliverables, timelines, and fees for each engagement are defined in a separate written proposal or service agreement signed by both parties.

These Terms govern the general relationship; the specific service agreement governs project-specific terms. Where the two conflict, the service agreement controls.

Fees are described in your service agreement. Standard payment terms:

• Setup/build fees: 50% due at project kickoff, 50% due at launch
• Monthly subscription fees (BuzFlo platform, ongoing services): billed in advance via auto-pay
• Invoices are due upon receipt unless otherwise specified
• Payments are processed via Stripe; we accept major credit cards, ACH, and wire transfer for larger invoices
• Late payments may accrue interest at 1.5% per month or the maximum allowed by law

Recurring services renew automatically unless cancelled in accordance with the cancellation terms below.

Most engagements include a 90-day initial commitment to allow services time to produce meaningful results. After the initial period, recurring services can be cancelled with 30 days written notice via email to info@buzflo.ai.

Setup fees, build fees, and one-time project fees are non-refundable once work has commenced. Pre-paid monthly fees are pro-rated upon cancellation. Custom code, designs, and deliverables completed prior to cancellation remain billable in full.

We reserve the right to terminate services for non-payment, breach of these terms, or behavior that creates a hostile working environment for our team. We will provide reasonable notice when possible.

Custom work created for you: Custom code, designs, content, and configurations developed specifically for your business become your intellectual property upon full payment of associated fees. We deliver source code, design files, and account access on request following final payment.

Pulse-owned platforms and frameworks: BuzFlo platform, our internal frameworks, reusable templates, and proprietary methodologies remain the property of Pulse Marketing Solutions LLC. You receive a license to use these as part of your engagement, not ownership.

Your data and content: All client data, content, contacts, and business information you provide to Pulse remains your property. You can request a full data export at any time.

Portfolio rights: Pulse may reference completed projects in our portfolio, marketing materials, and case studies with publicly visible information unless explicitly restricted in your service agreement.

To the maximum extent permitted by law, Pulse Marketing Solutions LLC's total liability for any claim arising out of or related to these terms or our services shall not exceed the fees paid by you to Pulse in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to loss of profits, revenue, data, or business opportunity — even if advised of the possibility of such damages.

Services are provided "as is" without warranties of any kind, except those that cannot be disclaimed under applicable law. We do not guarantee specific business outcomes (e.g., revenue, leads, rankings) — we guarantee professional execution of agreed-upon services.

We may update these Terms of Service from time to time. Material changes will be communicated via email to active clients and posted at the top of this page with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated terms.

We collect information you provide directly:

• Contact information (name, email, phone, business name) submitted through forms
• Account credentials and profile information for BuzFlo and other platforms
• Payment information (processed and stored securely by Stripe — we never store full card numbers)
• Communications (emails, calls, SMS, chat messages) you exchange with our team
• Project data (assets, content, business information) shared during engagements

We also collect information automatically:

• Website analytics (pages visited, referring sources, device/browser info) via Google Analytics
• Cookies and tracking pixels for marketing and conversion attribution
• Server logs (IP address, access times) for security and operational purposes

We use your information to:

• Deliver the services you've engaged us for
• Process payments and manage your account
• Communicate with you about your project, billing, and service updates
• Respond to your questions and requests
• Improve our services and develop new offerings
• Send marketing communications (only with your consent — see Communication Consent below)
• Comply with legal obligations and protect our rights

We do not sell your personal information. We share data only when necessary:

• Service providers: Companies that help us deliver services (e.g., Stripe for payments, Google Workspace for email, GoHighLevel for CRM, Twilio for SMS, Mailgun for email delivery, Vercel for hosting)
• Your authorized integrations: Tools you've connected to BuzFlo (e.g., your accounting software, calendar, EHR)
• Legal compliance: When required by law, court order, or to protect rights and safety
• Business transfers: In the event of merger, acquisition, or asset sale, your data may transfer to the new entity (with notice)

All service providers are contractually obligated to handle your data consistent with this policy and applicable law.

We retain your information for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce agreements.

After account termination, we retain core business records (invoices, contracts, communications related to delivered services) for 7 years for tax and legal compliance. Marketing data and tracking data are deleted within 90 days of cancellation upon request.

You have the right to:

• Access the personal information we hold about you
• Request corrections to inaccurate information
• Request deletion of your data (subject to legal retention requirements)
• Export your data in a portable format
• Opt out of marketing communications at any time
• Withdraw consent for data processing where consent is the legal basis

To exercise these rights, email info@buzflo.ai with the subject "Privacy Request." We respond within 30 days.

California residents (CCPA): You have additional rights to know, delete, and opt out of "sale" of personal information (we don't sell — but you have the right to confirm).

EU/UK residents (GDPR): You have rights to data portability, restriction of processing, and lodging complaints with supervisory authorities.

We use cookies and similar technologies to operate our website, remember your preferences, measure performance, and support marketing efforts. Cookie types we use:

• Essential: Required for the website to function (cannot be disabled)
• Analytics: Google Analytics for understanding usage patterns
• Marketing: Meta Pixel, Google Ads, LinkedIn Insight Tag for conversion tracking

You can control cookies through your browser settings or our cookie consent banner. Disabling certain cookies may affect site functionality.

By providing your phone number and checking the consent box on our forms, you agree to receive SMS messages from Pulse Marketing Solutions LLC, including:

• Appointment confirmations and reminders
• Account and service notifications
• Marketing messages and promotions (only with explicit opt-in)
• Customer support communications

Message frequency: Varies by service. Marketing SMS limited to a reasonable cadence (typically <4/month).

Message and data rates: May apply per your carrier.

We comply with TCPA regulations and do not share SMS opt-in data with third parties for marketing purposes.

By submitting your email through our forms, you consent to receive transactional emails (related to your services) and marketing emails (only when you've explicitly opted in).

We comply with CAN-SPAM Act requirements: every marketing email includes our physical mailing address, a clear sender identification, and an unsubscribe link that processes within 10 days.

SMS: Reply STOP to any message from us, or email info@buzflo.ai. Opt-out is immediate.

Email: Click the unsubscribe link at the bottom of any marketing email. Opt-out processes within 10 business days.

All communications: Email info@buzflo.ai with subject "Unsubscribe All" to be removed from all marketing lists.

Note: Opting out of marketing does NOT stop transactional communications (billing, service updates, account security) which are required to deliver services you've engaged.
